ROSCO LAWYERS PROTECTED THE CLIENT'S MONEY DURING THE TRIAL

A number of contracts for the supply of agricultural machinery were concluded between a foreign and a Russian company. Under one of them, the parties have agreed on strict requirements for the appearance of products supplied under this particular contract. In case of their violation, the supplier had to pay a fine in the amount of 50 000 US dollars.

In the course of supplying various agricultural machinery, including under the disputed contract, the buyer has filed claims to recover a fine of 100,000 US dollars from the supplier as the supplier has allegedly supplied agricultural machinery not meeting the contractual requirements for appearance several times.

However, the supplier did not agree with the claims filed. During the trial in case No. А43-37118/2019, RosCo lawyers helped the supplier to prove that the machinery supplied by it fully met the contractual requirements, while the buyer, when “identifying deficiencies,” committed numerous violations of the acceptance procedure and actually forged the acts of recording “deficiencies of machinery supplied under the contract.” In this regard, Plaintiff’s action was dismissed in full, and RosCo helped the client to save money in the amount of 100,000 US dollars.
