ROSCO LAWYERS HELPED TO RECOVER FUNDS FOR OUR CLIENT FALCON CONSTRUCTION LTD

Our professionals helped to collect and recover funds from the counterparty at the stage of enforcement proceedings. FALCON CONSTRUCTION LLC filed a lawsuit against SPETSTECHMONTAZH LLC for recovery of unjust enrichment in the amount of 3,931,160.36. The claim was satisfied in full by the decision of the Moscow City Court of Arbitration.

By Resolution No. 09 AP -14118/2022 dated 04.04.2022 of the Ninth Arbitration Court of Appeal the first instance decision was upheld. The court of Cassation instance, according to the decision of the Moscow District Court of Arbitration of 27.07.2022 the decision of the court of first instance and the decision of the court of appeal, left without change, the cassation complaint without satisfaction. A writ of execution was filed with the Bailiff Service, the debtor's property was seized, and the judgement was eventually executed in full.

Funds were debited from the debtor's account by the bailiff-executor as part of the enforcement proceedings.
